ARTICLE 19 - MISCELLANEOUS

Section 1 - Voting Eligibility

In all cases where a secret mail ballot is held or is required to be held by this Constitution and By-Laws, active members eligible to vote shall be those members classified as active at the close of business of the last business day prior to the date the person conducting the ballots commences to mail out the ballots. No other persons shall vote.

Section 2 - Plurality
  1. In this Constitution and By-Laws words signifying a male person include a female person and words signifying a female person include a male person.

  2. In this Constitution and By-Laws, words in the singular include the plural, and words in the plural include the singular.

  3. In this Constitution and By-Laws, where a number of days is specified, the first day shall be excluded and the last day shall be included.

  4. In the Constitution and By-Laws, "shall" is to be construed as imperative.

Section 3 - Serving Documents

In this Constitution and By-Laws where any document or thing is required to be served on any person, the document or thing may be served on that person by:
  1. sending it by registered mail or certified mail to his last known address; or

  2. in person.
Section 4

Where a document or thing is served by registered mail, it shall be deemed to have been served on the second day following the date it was mailed.

Section 5 - Adoption

Upon the adoption of this Constitution and By-Laws, the Constitution of the Canadian Union of United Brewery, Flour, Cereal, Soft Drink and Distillery Workers shall cease to apply to the Union or any member or officer of this Union.

Section 6 - Successorship

This Constitution and By-Laws shall supersede the Constitution and By-Laws of the Brewery and Soft Drink Workers, Local 300.

Section 7 - Majority

Unless otherwise specified herein, where any thing or matter requires a vote in order to be approved, the thing or matter shall be approved if more than fifty percent (50%) of those voting vote to approve.
